If you are searching this, you probably heard about Amendment 3 — the ballot initiative that would have legalized recreational marijuana in Florida. It did not pass. It needed 60% of the vote and fell short in November 2024.
There is no recreational marijuana measure on the 2026 ballot either. So the short answer: recreational marijuana remains illegal in Florida, and there is no clear timeline for when that changes.
What This Means for You
If you want legal access to marijuana in Florida right now, you need a medical marijuana card. That is the only legal pathway. There is no gray area, no decriminalization loophole, no delta-8 workaround that gives you the same legal protection.
Possession of marijuana without a medical card in Florida is still a criminal offense — up to a year in jail for under 20 grams, and a felony for over 20 grams.
How Florida's Medical Marijuana Program Works
The medical marijuana program has been operating since 2016, and as of 2026, over 850,000 Floridians hold active cards. The process is straightforward:
- See a qualified physician — The doctor evaluates whether you have a qualifying condition
- Get entered into the Medical Marijuana Use Registry — Your physician does this
- Pay the state fee — $75 for a 210-day card
- Receive your card — Usually within 5-10 business days

Why Amendment 3 Failed
The initiative received about 57% of the vote — a majority, but not the 60% supermajority Florida requires for constitutional amendments. Opposition focused on concerns about corporate monopoly structures in the proposed law and DUI enforcement gaps.
Whether a new recreational initiative appears in 2028 depends on funding and political dynamics. Several organizations are already exploring it, but nothing is confirmed.

- Legal protections for employment in some cases
